VILLAGE OF CORRALES ORDINANCE NO. 07-015

AN ORDINANCE RELATING TO VILLAGE LAWS, ADOPTING AND ORDAINING A NEW CODE OF ORDINANCES FOR THE VILLAGE OF CORRALES, NEW MEXICO; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN, WITH CERTAIN EXCEPTIONS; PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE AND THE CODE.

BE IT ORDAINED BY THE GOVERNING BODY OF THE VILLAGE OF CORRALES, NEW MEXICO:

Section 1. This ordinance adopts a Code of Ordinances entitled “Code of Ordinances, Village of Corrales, New Mexico,” hereinafter referred to as the “Corrales Village Code” which is to be considered as a new and original comprehensive ordinance, as compiled, consolidated, codified and indexed, which shall supersede all other general and permanent ordinances passed by the governing body on or after the adoption date of this Ordinance, except as otherwise herein provided.

Section 2. All ordinances of a general and permanent nature adopted prior to the effective date of this Ordinance, and not contained in the Corrales Village Code or recognized and continued in force by reference therein, are repealed. Reference is made to section 1-9 of the Code titled “Ordinances not affected by Code.”

Section 3. The repeal provided for in Section 2 shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this ordinance.

Section 4. Whenever in the Corrales Village Code adopted by this ordinance or in any other ordinance or resolution of the Village or in any rule, regulation or order promulgated by the governing body or officer of the Village under authority duly vested in him or her or any act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefore, the violation of any such provision of the Corrales Village Code or any other ordinance or resolution of the Village or such rule, regulation or order shall be punished by a fine and/or imprisonment, or by both such fine and imprisonment as provided in Section 1-6 of the Code. Except where otherwise provided, every day any violation of the Corrales Village Code or any other ordinance or resolution of the Village or of such rule, regulation or order continues shall constitute a separate offense.

Section 5. Any and all additions and amendments to the Corrales Village Code, when passed in such form as to indicate the intention of the governing body to make the same a part thereof, shall be deemed to be incorporated in the Corrales Village Code so that the reference to the Corrales Village Code shall be understood and intended to include such additions and amendments.

Section 6. A copy of the Corrales Village Code shall be kept on file in the office of the Village Clerk preserved in loose-leaf form, or in such other form as the Clerk may consider most expedient. It is the duty of the Clerk to insert in their designated places all amendments or ordinances which indicate the intention of the governing body to make the same a part of the Corrales Village Code and to extract from the Corrales Village Code all provisions which may be from time to time repealed by the governing body. This copy of the Corrales Village Code shall be available for any person desiring to examine the Code during normal working hours. Copies of the Corrales Village Code may be purchased from the Village at a reasonable fee determined by the Clerk necessary for the reproduction and handling of the Code.

Section 7. It shall be unlawful for any person to change or amend, by additions or deletions, any part or portion of the Corrales Village Code, or to insert or delete pages, or portions thereof, or to alter or tamper with the Code in any manner whatsoever which will cause the laws of the Village to be misrepresented. Any person violating this section shall be punished as provided in Section 4 of this ordinance.

Section 8. The Code shall hereafter be received without further proof in all courts of competent jurisdiction and administrative tribunals of the state as the ordinances of a general and permanent nature of the Village.

Section 9. Severability clause. Should any section, paragraph, clause or provision of this ordinance, for any reason, be held to be invalid or unenforceable, the invalidity and unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this ordinance and each section, subsection, sentence, clause, word, or phrase thereof irrespective of anyone or more sections, subsection, sentences, clauses, words, or phrases being declared unconstitutional or otherwise invalid.

Section 10. Effective date and publication. This ordinance shall become effective and be in full force and effect from and after its passage, publication and posting, according to law.
